Privacy Policy

1. This Privacy Policy sets out the principles of processing personal data obtained through the online store under the domains www.revolubes.pl and www.revolubes.eu (hereinafter referred to as the "Online Store").

2. The owner of the Online Store and the data administrator is Janina Małecka-Ulińska conducting business under the name JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA with its registered office in Starachowice (27-200), ul. Stanisława Wigury 23, entered into the Central Register and Information on Economic Activity kept by the Minister of Development and Technology, Tax Identification Number (NIP): 6641156609, National Business Registry Number (REGON): 260231086, hereinafter referred to as JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA.

3. Personal data collected by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA through the Online Store is processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), also known as GDPR.

4. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA takes special care to respect the privacy of Customers visiting the Online Store.

 

§ 1 Type of processed data, purposes, and legal basis

 

1. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA collects information regarding individuals who perform a legal action not directly related to their business activities, individuals conducting business or professional activities on their own behalf, and individuals representing legal persons or organizational units that are not legal entities but have legal capacity, hereinafter collectively referred to as "Customers."

2. Personal data of Customers is collected in the following cases:

a) Registration of an account in the Online Store, for the purpose of creating an individual account and managing it. Legal basis: necessity for the performance of a contract for the provision of Account services (Article 6(1)(b) of the GDPR).

b) Placing an order in the Online Store, for the purpose of executing a sales contract. Legal basis: necessity for the performance of a sales contract (Article 6(1)(b) of the GDPR).

c) Subscription to the newsletter (Newsletter), for the purpose of executing a contract for an electronically provided service. Legal basis: consent of the data subject to the performance of a contract for the provision of Newsletter service (Article 6(1)(a) of the GDPR).

d) Using the contact form service in the Online Store, for the purpose of executing a contract for an electronically provided service. Legal basis: necessity for the performance of a contract for the provision of the contact form service (Article 6(1)(b) of the GDPR).

3. In the case of registering an account in the Online Store, the Customer provides:

a) Email address;

b) First name and last name;

c) Phone number.

4. During the registration of an account in the Online Store, the Customer independently sets an individual password to access their account. The Customer may change the password at a later time, according to the rules described in §5.

5. In the case of placing an order in the Online Store, the Customer provides the following information:

a) Email address;

b) Address details:

a. Postal code and city;

b. Country;

c. Street name and house/apartment number.

c) First name and last name;

d) Phone number.

6. In the case of Business Customers, the above scope of data is additionally expanded to include:

a) Company name;

b) Tax Identification Number (NIP).

7. In the case of using the Newsletter service, the Customer only provides their email address.

8. In the case of using the contact form service, the Customer provides the following information:

a) Email address;

b) First name and last name;

c) Phone number.

9. While using the Website of the Online Store, additional information may be collected, particularly the IP address assigned to the Customer's computer or the external IP address of the Internet service provider, domain name, browser type, access time, and operating system type.

10. Navigational data, including information about the links and references they choose to click on or other actions taken in the Online Store, may also be collected from Customers. The legal basis for this is a legitimate interest (Article 6(1)(f) of the GDPR), which aims to facilitate the use of electronically provided services and improve their functionality.

11. In order to establish, investigate, and enforce claims, certain personal data provided by the Customer when using the functionalities in the Online Store, such as first name, last name, data regarding the use of services (if claims arise from the way the Customer uses the services), and other data necessary to prove the existence of a claim, including the extent of the incurred damage, may be processed. The legal basis for this is a legitimate interest (Article 6(1)(f) of the GDPR), which involves establishing, investigating, and enforcing claims, as well as defending against claims in proceedings before courts and other government authorities.

12. The provision of personal data to JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA is voluntary in connection with concluded sales agreements or the provision of services through the Online Store's Website. However, it should be noted that failure to provide certain data in the registration process renders registration and the creation of a Customer Account impossible. Additionally, in the case of placing an order without registering a Customer Account, it will be impossible to submit and process the Customer's order.

§ 2 To whom are the data disclosed or entrusted, and how long are they stored?

 

1. The Customer's personal data is shared with service providers used by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA in operating the Online Store. Depending on contractual agreements and circumstances, the service providers to whom personal data is shared either follow the instructions of JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA regarding the purposes and methods of processing the data (data processors), or independently determine the purposes and methods of their processing (data administrators).

a) Data processors: JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA uses providers who process personal data solely on behalf of JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA. These may include hosting service providers, accounting services, providers of marketing systems, systems for analyzing traffic in the Online Store, and systems for analyzing the effectiveness of marketing campaigns.

b) Data administrators: JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA uses providers who do not act solely on instructions and independently determine the purposes and methods of using Customer's personal data. They provide electronic payment services and banking services.

2. Location: The service providers have offices in Poland and other countries within the European Economic Area (EEA).

3. Customers' personal data is stored as follows:

a) When the legal basis for processing personal data is consent, the Customer's personal data is processed by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA until the consent is withdrawn. After the withdrawal of consent, the data will be retained for a period corresponding to the statute of limitations for claims that JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA may raise or be raised against them. Unless otherwise specified by specific regulations, the limitation period is six years, and for claims regarding periodic benefits and claims related to business activity, it is three years.

b) When the legal basis for processing data is the performance of a contract, the Customer's personal data is processed by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA for as long as necessary to fulfill the contract. After that period, the data will be retained for a period corresponding to the statute of limitations for claims. Unless otherwise specified by specific regulations, the limitation period is six years, and for claims regarding periodic benefits and claims related to business activity, it is three years.

4. In the case of making a purchase in the Online Store, personal data may be transferred to a courier company for the purpose of delivering the ordered goods.

5. In the event that the Customer chooses to make a payment through the przelewy24.pl system, their personal data is transferred to PayPro S.A., located in Poznań, Poland (60-198 Poznań, ul. Pastelowa 8, 60-198), registered in the business register maintained by the District Court Poznań - Nowe Miasto i Wilda in Poznań, 8th Commercial Department of the National Court Register, under the registration number KRS 0000347935, VAT identification number (NIP) 7792369887, and National Business Registry Number (Regon) 301345068, to the extent necessary for payment processing.

6. Navigational data may be used to provide customers with better service, analyze statistical data, customize the Online Store to customers' preferences, and administer the Online Store.

7. If a customer subscribes to the informational newsletter (Newsletter) using their email address, JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA will send electronic messages containing commercial information about promotions and new products available in the Online Store.

8. In the event of a request from JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA, personal data may be provided to authorized state authorities, particularly to the organizational units of the Prosecutor's Office, Police, President of the Personal Data Protection Office, President of the Office for Competition and Consumer Protection, or President of the Office of Electronic Communications.

 

§ 3 Cookies Mechanism, IP Address

 

1. The Online Store uses small files called cookies. They are stored by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA on the end device of the person visiting the Online Store, if the web browser allows it. A cookie file usually contains the domain name it comes from, its "expiration time," and a randomly chosen unique number identifying that file. The information collected through such files helps to tailor the products offered by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA to the individual preferences and actual needs of the visitors to the Online Store. 3. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA uses its own cookies for the following purposes:

a) Authenticating the customer in the Online Store and ensuring the customer's session in the Online Store (after logging in), so that the customer does not have to re-enter their login and password on every subpage of the Online Store.

b) Analyzing, researching, and auditing page views, particularly for creating anonymous statistics that help understand how customers use the Online Store's website, enabling improvements to its structure and content.

4. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA uses external cookies for the following purposes:

a) Collecting general and anonymous statistical data through Google Analytics tools (external cookies administrator: Google LLC based in the USA).

b) Presenting the Reliable Terms and Conditions Certificate through the rzetelnyregulamin.pl website (external cookies administrator: Rzetelna Grupa sp. z o.o. based in Warsaw).

5. The cookies mechanism is safe for the customers' computers in the Online Store. Specifically, it is not possible for viruses, unwanted software, or malicious software to penetrate customers' computers through this means. However, customers have the option to limit or disable the access of cookie files to their computers through their web browsers. If this option is chosen, it may limit the functionality of the Online Store, excluding features that inherently require cookies.

6. Below, we present how you can change the settings regarding the use of cookies in popular web browsers:

a) Chrome and Chrome Mobile browser;

b) Facebook in-app Browser;

c) Internet Explorer browser;

d) Microsoft Edge browser;

e) Mozilla Firefox browser;

f) Opera browser;

g) Safari and Safari Mobile browser;

h) Samsung Browser.

Please note that the specific instructions for changing cookie settings may vary depending on the version and configuration of the respective browser.

7. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA may collect customers' IP addresses. An IP address is a number assigned to the computer of a person visiting the Online Store by their internet service provider. The IP number allows access to the Internet. In most cases, it is dynamically assigned to the computer, meaning it changes with each internet connection. The IP address is used by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA for diagnosing technical issues with the server, creating statistical analyses (e.g., determining the regions with the highest number of visits), as useful information for administering and improving the Online Store, as well as for security purposes and identifying any unwanted automated programs browsing the Online Store's content.

8. The Online Store contains links and references to other websites. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA is not responsible for the privacy policies applicable to those websites.

§ 4 Rights of Data Subjects

 

1. Right to withdraw consent - legal basis: Article 7(3) of the GDPR.

a) The customer has the right to withdraw any consent given to JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA.

b) The withdrawal of consent takes effect from the moment of withdrawal.

c) The withdrawal of consent does not affect the lawfulness of processing carried out by JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA based on the consent before its withdrawal.

d) The withdrawal of consent does not have any negative consequences for the customer, but it may prevent further use of services or functionalities that JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA can provide only with consent, as permitted by law.

2. Right to object to data processing - legal basis: Article 21 of the GDPR.

a) The customer has the right to object, at any time, on grounds relating to their particular situation, to the processing of their personal data, including profiling, if JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA processes their data based on a legitimate interest, such as marketing JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA's products and services, conducting statistics on the use of specific functionalities of the Online Store, facilitating the use of the Online Store, and conducting customer satisfaction surveys.

b) Opting out, such as by sending an email to stop receiving marketing communications about products or services, will constitute the customer's objection to the processing of their personal data, including profiling, for such purposes.

c) If the customer's objection is justified and JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA does not have any other legal basis for processing the personal data, the customer's personal data will be deleted with respect to the processing to which the objection relates.

3. Right to erasure ("right to be forgotten") - legal basis: Article 17 of the GDPR.

a) The customer has the right to request the erasure of all or some of their personal data.

b) The customer has the right to request the erasure of personal data if:

a. the personal data is no longer necessary for the purposes for which it was collected or processed;

b. the customer has withdrawn their specific consent, to the extent that the processing of personal data was based on their consent;

c. the customer has objected to the use of their data for marketing purposes;

d. the personal data is being processed unlawfully;

e. the personal data must be erased to comply with a legal obligation under EU law or the law of a Member State to which JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA is subject; f. the personal data has been collected in relation to the offer of information society services.

c) Despite a request for the erasure of personal data due to objection or withdrawal of consent, JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA may retain certain personal data to the extent that processing is necessary for the establishment, exercise, or defense of legal claims, as well as to fulfill a legal obligation that requires processing under EU law or the law of a Member State to which JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA is subject. This applies in particular to personal data including: name, email address, which are retained for the purposes of handling complaints and claims related to the use of JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA's services, as well as additionally, the residential/correspondence address and order number, which are retained for the purposes of handling complaints and claims related to concluded sales contracts or the provision of services.

4. Right to restriction of processing - legal basis: Article 18 of the GDPR.

a) The customer has the right to request the restriction of processing of their personal data. Submitting such a request will temporarily limit the use of certain functionalities or services that involve the processing of the data covered by the request. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA will also refrain from sending any communications, including marketing messages, during the processing of the request.

b) The customer has the right to request the restriction of the use of their personal data in the following cases:

a. When the accuracy of their personal data is contested - in such cases, JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA will limit the use of the data for the time necessary to verify its accuracy, but no longer than 7 days.

b. When the processing of data is unlawful, and instead of erasing the data, the customer requests the restriction of its use.

c. When the personal data is no longer necessary for the purposes for which it was collected or used, but the customer requires it for the establishment, exercise, or defense of legal claims.

d. When the customer has objected to the use of their data - in such cases, the restriction will be applied for the time needed to assess whether, due to the customer's specific situation, their interests, rights, and freedoms outweigh the interests pursued by the data controller while processing the customer's personal data.

5. Right of access to data - legal basis: Article 15 of the GDPR.

a) The customer has the right to obtain confirmation from the data controller as to whether or not personal data concerning them is being processed. If such processing takes place, the customer has the right to:

a. Access their personal data.

b. Obtain information about the purposes of the processing, the categories of personal data being processed, the recipients or categories of recipients to whom the data is disclosed, the envisaged period of storage of the customer's data or the criteria for determining that period (when the determination of the intended processing period is not possible), the rights granted to the customer under the GDPR, the right to lodge a complaint with a supervisory authority, the source of the data, the existence of automated decision-making, including profiling, and the safeguards relating to the transfer of the data outside the European Union.

c. Obtain a copy of their personal data.

6. Right to rectification of data - legal basis: Article 16 of the GDPR.

a) The customer has the right to request the data controller to rectify without undue delay any inaccurate personal data concerning them. Taking into account the purposes of the processing, the customer whose data is being processed has the right to request the completion of incomplete personal data, including by providing an additional statement, directing the request to the email address in accordance with §6 of the Privacy Policy.

7. Right to data portability - legal basis: Article 20 of the GDPR.

a) The customer has the right to receive their personal data provided to the data controller and transmit those data to another selected data controller. The customer also has the right to request that the personal data be transmitted directly by the data controller to another data controller, if technically feasible. In such a case, the data controller will provide the customer's personal data in a CSV file format, which is commonly used, machine-readable, and allows for the transfer of the received data to another data controller.

8. In the event that the customer exercises their rights based on the above-mentioned rights, JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA will fulfill the request or refuse to fulfill it immediately, but no later than one month after receiving it. However, if due to the complex nature of the request or the number of requests, JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA is unable to fulfill the request within one month, it will fulfill it within the next two months, informing the customer in advance within one month of receiving the request about the intended extension and the reasons for it.

9. The customer can submit complaints, inquiries, and requests regarding the processing of their personal data and the exercise of their rights to the data controller.

10. The customer has the right to request JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA to provide a copy of the standard contractual clauses by directing the request as indicated in §6 of the Privacy Policy.

11. The customer has the right to lodge a complaint with the President of the Personal Data Protection Office regarding the infringement of their rights related to the protection of personal data or other rights granted under the GDPR.

§ 5 Security Management – Password

 

1. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA ensures secure and encrypted connection when transmitting personal data and during customer login to their account on the website. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA uses an SSL certificate issued by one of the leading global companies in the field of security and encryption of data transmitted over the Internet.

2. In the event that a customer who has an account in the Online Store loses their access password in any way, the Online Store allows for the generation of a new password. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA does not send password reminders. The password is stored in an encrypted form, making it impossible to read. To generate a new password, the customer needs to provide their email address in the form available under the "Forgot your password" link provided on the login form of the Online Store. The customer will receive an email message containing a redirection to a dedicated form provided on the Store's website, where they will have the opportunity to set a new password.

3. JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA never sends any correspondence, including electronic correspondence, requesting the disclosure of login data, especially the customer's access password to their account.

 

§ 6 Privacy Policy Changes

 

1. The Privacy Policy may be subject to changes, which JANINA MAŁECKA-ULIŃSKA EKO SYSTEMY FIRMA HANDLOWO-USŁUGOWA will inform customers about at least 7 days in advance.
